Lotame Standard Contractual Clauses

As a result of the recent Court of Justice of the European Union ruling examining transfers of data from the EU, invalidating the E.U. - U.S. Privacy Shield, Lotame will be moving to Standard Contractual Clauses (SCCs) for transfers of online advertising and measurement of personal data out of the European Economic Area, Switzerland, and the UK.

As a global organization, Lotame operates both within and outside the European Economic Area. Therefore, and given the recent European guidance as well as the U.S. Department of Commerce advisory, we are updating our existing agreements with you to add the relevant SCCs as adopted and approved by the European Commission.

These updates do not create additional rights to Lotame over data. The SCCs, as adopted by you, solely address GDPR compliance and our ability to continue to transfer data as described above.

If the SCCs are already part of your contract, no further action is required. For customers that do not currently have SCCs in place, Lotame has attached a pre-signed applicable SCCs for your review and records. Please have an authorized signatory confirm agreement with these terms by filling out the below. Also included on our website is the ability to upload a countersigned version of the SCCs should an authorized signatory of your company prefer this route.  The SCC updates will apply from August 7, 2020. 

We continue to review continued guidance and updates in light of this decision, and participate with industry groups in understanding and proactively working with relevant parties to address the issues raised by the ruling.
